Terms of Use

These terms cover your use of GeoNotes, whether you use it in a browser, install it as an app, or run it from an app store. By using GeoNotes you agree to them. If you do not, please do not use it.
1. What GeoNotes is
GeoNotes is a personal note-taking application. It lets you write short notes that are pinned to the place where you wrote them, keeps them on your device, and optionally syncs them across your devices if you create an account. It is provided free of charge and for personal use.
It is a small, independently built application, not a business with a support desk. It is offered as-is.
GeoNotes is operated by Victor Santos, an independent developer based in the State of Florida, United States. That is who “we” and “us” mean throughout these terms, and who you are agreeing with.
2. Accounts
You do not need an account to use GeoNotes. If you create one, you agree that:
- the e-mail address you give is one you control;
- you are responsible for the security of that e-mail account and of the devices holding your passkeys, since either can be used to sign in;
- you will not share your account with someone else or let anyone else sign in as you;
- you are at least 13 years old.
You are responsible for what happens under your account. Tell us promptly if you believe it has been accessed by someone else.
3. Your notes are yours
You keep every right you have in what you write. We claim no ownership of your notes and no licence to use them beyond the strictly technical one needed to run the service: storing them, transmitting them between your devices and displaying them back to you.
We do not read your notes, mine them, sell them, share them or use them to train anything. Note that they are stored in ordinary form on the server, coordinates included, and are not end-to-end encrypted, so please do not store passwords, financial details, or anything else genuinely sensitive in GeoNotes.
4. Acceptable use
Do not use GeoNotes to store or transmit anything unlawful, or to harm the service or other people. Specifically, you agree not to:
- store or distribute content that is illegal where you are, or that infringes someone else's rights;
- use the service to harass, threaten, stalk or track another person;
- attempt to gain access to another user's account or data;
- probe, scan, overload or otherwise interfere with the service or the infrastructure it runs on;
- use automated means to create accounts, request sign-in codes or bulk-extract data;
- resell the service or present it as your own.
Accounts used in these ways may be suspended or removed without notice.
5. Deletion is permanent
When you delete a note it is gone. There is no trash, no undo and no recovery, on your device or on our servers. Deleting your account starts a 30-day grace window during which you can restore everything by recovering the account: we e-mail you a code, and once you have entered it you add a new passkey. After the window, your account and all of its data are erased permanently and cannot be retrieved. This is deliberate. Keep your own copy of anything you would be sorry to lose.
6. Availability and changes
GeoNotes is free, which also means nothing here is a guarantee of uptime. The service may be unavailable, may lose functionality, may change, and may one day be discontinued. We will give reasonable notice in the app before shutting it down, so that you can export or copy what matters to you, but we cannot promise it will always be there.
Features may be added, altered or removed at any time.
7. Location and third-party data
GeoNotes uses your device's location only while the app is open, and only to attach a place to a note you are creating. Granting that permission is your choice, but a note cannot be created without it: creating one requires a fix accurate to about 30 metres, so refusing the permission, or granting only an approximate location, leaves the app able to show the notes you have and edit their text, but not to add new ones or update where an existing note is pinned. Addresses are supplied by OpenStreetMap and are © OpenStreetMap contributors (https://www.openstreetmap.org/copyright), used under the Open Database Licence (https://opendatacommons.org/licenses/odbl/1-0/). Addresses are approximate and are provided for convenience, not for navigation, emergency use or any purpose where accuracy matters.
8. No warranty
GeoNotes is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that your data will never be lost.
Do not rely on GeoNotes as the only copy of important information, and do not rely on it for anything safety-critical.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits, revenue or goodwill, arising out of or connected with your use of GeoNotes. Where liability cannot be excluded, it is limited to the amount you have paid for the service, which for a free service is nothing.
Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you. Nothing here limits liability for fraud, or for death or personal injury caused by negligence, where the law does not permit that limitation.
10. Ending your use
You may stop using GeoNotes at any time, and delete your account from within the app or from the public deletion page at gnotes.vshub.app/delete-account. We may suspend or end your access if you breach these terms or if we discontinue the service.
11. Changes to these terms
These terms may be updated. The date at the top will change, and significant changes will be announced in the app. If you keep using GeoNotes after a change takes effect, the revised terms apply to you.
12. Governing law
These terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law rules, and any dispute will be brought before the courts located there. If you are a consumer, this does not deprive you of the protection of mandatory rules of the country where you live.
13. Miscellaneous
If any provision of these terms is found unenforceable, the rest stays in force. Not enforcing a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between you and us about GeoNotes.
